Terms and Conditions (T&C)
- Scope
1.1 These Terms and Conditions (T&C) apply to all contracts, services, and offers provided by David Jurzyca Consulting.
1.2 Deviating or supplementary terms of the customer will only become part of the contract if expressly acknowledged by us in writing.
1.3 These T&C apply to both businesses and consumers as defined in § 13 BGB, unless otherwise agreed.
- Services
2.1 David Jurzyca Consulting offers services in the areas of leadership coaching, sales strategies, and procurement.
2.2 The scope of services is determined by the respective contract or offer.
2.3 We reserve the right to replace parts of the agreed services with equivalent alternatives if necessary and reasonable for the customer.
- Conclusion of Contract
3.1 The contract is concluded when the customer accepts a written or electronic offer from David Jurzyca Consulting.
3.2 Offers are non-binding and subject to change unless explicitly stated otherwise.
- Payment Terms
4.1 The remuneration for our services is based on the agreed offer or contract.
4.2 Payments are due in full within 14 days of invoicing unless otherwise agreed.
4.3 In the event of late payment, we are entitled to charge default interest of 8% above the base rate.
- Liability
5.1 We are fully liable for intent and gross negligence, as well as for damages resulting from injury to life, body, or health.
5.2 For slight negligence, we are only liable for breaches of essential contractual obligations and limited to foreseeable damages typical for the contract.
5.3 Any further liability claims are excluded.
- Confidentiality
6.1 Both parties commit to treating all confidential information obtained during the collaboration as strictly confidential.
6.2 This obligation extends beyond the end of the contract.
- Final Provisions
7.1 The laws of the Federal Republic of Germany apply.
7.2 The place of performance and jurisdiction for all disputes arising from this contract is the registered office of David Jurzyca Consulting.
7.3 Should any provisions of these T&C be invalid, the validity of the remaining provisions remains unaffected.
- Cancellation Policy
8.1 Cancellations by the customer must be made in writing.
8.2 Cancellations made less than 24 hours before the agreed appointment will be charged at 50% of the agreed fee.
8.3 In the event of a no-show without prior cancellation, the full fee will be charged.
- Usage Rights to Results
9.1 All documents, reports, and strategies created as part of the collaboration remain the property of David Jurzyca Consulting unless otherwise agreed in writing.
9.2 The customer is granted a simple usage right to the results for their own use.
9.3 Any distribution to third parties or commercial use of the results requires prior written consent.
- Data Processing and Privacy
10.1 The processing of customer data complies with the General Data Protection Regulation (GDPR).
10.2 Customer data will be treated confidentially and not shared with third parties without explicit consent unless required by law.
10.3 Upon request, the customer may access information about the data stored and its usage at any time.
- Service Period
11.1 The agreed services must be used within six months of contract conclusion unless otherwise agreed in writing.
11.2 Claims for unused services expire after the service period ends.
